Agreement to these terms
ArtKeeper is the trading name of Dilyana Vanchurova-Rusanova, a sole trader based at 1660 Dumbarton Road, Glasgow G14 9YE, Scotland ("we", "us", "our").
We operate the website https://www.artkeeper.co.uk (the "Site") and the ArtKeeper artwork-keepsake service described below (together, the "Services").
ArtKeeper turns children's artwork into books, physical collages, prints, and related keepsakes. You order a box online; we send you the box with a Submission Form and prepaid return label; you post your child's artwork back to us; we photograph, digitise, and design it into the product(s) you've chosen; you approve a digital proof; we produce and return the finished item(s) along with your original artwork.
These terms are a legally binding agreement between you and us governing your use of the Site and purchase of our Services. By placing an order, you agree to be bound by these terms. If you do not agree, do not use the Services.
We may update these terms from time to time. Material changes will be posted on the Site, with the "Last updated" date revised accordingly.
Our website does not verify the age of visitors or purchasers. By placing an order, you confirm you are 18 years of age or older. Our products are designed for use by children under the direction and purchase of a parent or guardian; the website itself is not directed at, or intended for use by, children.
1. Intellectual property
We own or have the necessary rights to use the content on the Site (including text, images, design, and branding). You may view and print pages of the Site for your own personal, non-commercial use. You may not reproduce, republish, or commercially exploit Site content without our written permission.
2. Your submitted artwork
By posting your child's artwork to us for production, you confirm and agree that:

You are the parent or legal guardian of the child whose artwork is submitted, or you otherwise have the guardian's authority to submit it and share related details with us.

You own the artwork, or have the necessary permission or authority to submit it to us for the purposes described here.

You grant us a licence to photograph, digitise, store, reproduce, and share the artwork (and digitised images of it) with our print fulfilment partners and/or e-book hosting provider solely for the purposes of producing, delivering, supporting, and resolving issues relating to the item(s) you've ordered.

We do not use your child's artwork or any identifying details for marketing or any other purpose beyond producing your order, unless you separately agree to this — we will ask you directly if we'd like to.

We photograph and digitise submitted artwork using our own equipment and business Google Workspace storage. Physical production of books, collages, and larger prints is currently carried out by third-party print fulfilment partners we work with for quality and turnaround; digital e-books are hosted via a third-party e-book platform. These partners may change over time as availability requires. Details of the categories of third parties who process your information on our behalf are explained in our Privacy Notice.

It may be necessary to remove tape, staples, clips, or other fasteners, or to detach artwork from a non-artwork backing (e.g. a frame or background sheet), to photograph it properly. We do not reattach or reassemble items disassembled for this purpose, and you acknowledge that some materials may not be returned in their original assembled state.

We will attempt to reproduce your artwork faithfully, but folded, creased, faded, or damaged originals may show these features in the final product. We may be able to offer additional retouching or restoration work for an additional fee, subject to assessment of the artwork (Section 6).
3. Products, pricing, and the order process

You order a box at the fixed price shown at checkout (any applicable discount codes are applied there) via the Site.

We send the box, a Submission Form, and a prepaid return label.

You return your child's artwork with the completed Submission Form.

We catalogue and photograph the artwork, then issue a second invoice based on the actual number of pieces and the product(s) you've chosen, before any design or production work begins. A price estimator is available on the Site before you order so you know roughly what to expect.

No work begins until the second invoice is paid in full. If you decide not to proceed once you see the second invoice, tell us and we will return your original artwork using the prepaid return label included with your submission kit. No further payment will be required beyond the submission kit fee already paid.

On payment of the second invoice, we begin design and layout work.

We send you a digital proof for approval before anything is sent to print.

On approval, we produce the finished item(s) via in-house printing and/or our print fulfilment partners, as applicable.

We return the finished item(s) and your original artwork to you.
Pricing is as displayed on the Site at the time of your order and is subject to change for future orders; the price agreed for your box order is fixed at the time of purchase. If we discover a pricing error before your final invoice is issued, we will contact you before proceeding, and you may cancel for a full refund of any amount already paid.
Prices are in GBP and paid by card via our payment processor.
The box price covers the preparation and dispatch of your submission kit, including the box, packing materials, and prepaid return postage (via Royal Mail or a courier such as DPD, depending on the size of item you're returning to us). These costs are committed specifically to your order once the submission kit is prepared and dispatched.
If you decide not to proceed after receiving your second invoice, we will return your original artwork using the prepaid return label included with your order. The submission kit fee remains payable, as the materials, preparation, and postage costs have already been incurred.
Digital proof approval
Before production begins, we provide a digital proof for your review. By approving the proof, you confirm that the design, layout, text, names, and other details shown are correct. We are not responsible for errors that were present in an approved proof. We remain responsible for errors introduced by us during production that differ from the approved proof.
4. Turnaround

Books: 2–4 weeks from our receipt of your artwork.

Collages: 3–5 weeks from our receipt of your artwork.
These are estimates and may vary with order volume and the complexity of your order.
5. Loss or damage of your artwork
We understand the artwork you send us is irreplaceable, and we take this seriously.

We use tracked delivery services and take reasonable care when handling your artwork.

If your artwork is lost or damaged while it is in our possession, or during return delivery arranged by us, please contact us and we will work with you to resolve the issue.

We are not responsible for damage caused by the condition of the artwork before we receive it, including existing folds, creases, fading, tears, or deterioration.

We photograph your outgoing package before dispatch and share this with you, confirming the condition it left us in.

Cosmetic wear to outer packaging alone is not grounds for a claim — the relevant question is whether the artwork or product itself is damaged.
This does not affect your statutory rights.
Original artwork
Unless you instruct us otherwise, your original artwork will be returned with your finished product.
If you cancel your order before production begins, we will return your original artwork using the prepaid return label included with your order.
If you request that we dispose of your original artwork, we will do so securely. We do not retain original artwork after completion of the return process, unless required for legal or dispute-resolution purposes.
If artwork cannot be returned due to circumstances outside our control, we will contact you and agree appropriate arrangements for its return or secure disposal.
6. Changes to your design
Following your review of the digital proof, you may request changes to the design. Customer-requested changes are charged at £30/hour (minimum one hour charge), payable before the changes are carried out. The scope of any requested changes will be agreed before work begins.
Changes required due to an error on our part will not incur an additional charge. Once the proof has been approved, the item proceeds to production.
7. Cancellation and your statutory rights
The submission kit fee covers the preparation and dispatch of your submission kit, including the box, materials, and prepaid return postage. These costs are committed specifically to your order once the submission kit has been prepared and dispatched. If you decide not to proceed with the service after receiving your second invoice, the submission kit fee remains payable.
Once we send your second invoice, you are not obliged to accept it — if you decide not to proceed, we return your original artwork using the already-paid return label included with your submission kit. No further payment will be required beyond the submission kit fee already paid.
Books, collages, and prints made from your submitted artwork are made to your specifications or are clearly personalised. Therefore, the standard 14-day cancellation right for distance purchases does not apply to these products under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.
Nothing in this section affects your statutory rights under the Consumer Rights Act 2015. If an item you receive is faulty, not as described, or not of satisfactory quality, you are entitled to a repair, replacement, price reduction, or refund as appropriate under that Act. Refunds — summary for the Site's Refunds page
The submission kit fee (covering the box, materials, and prepaid return postage) covers costs committed specifically to your order once the kit has been prepared and dispatched, and remains payable if you decide not to proceed after receiving your second invoice. Please see these Terms and Conditions for full details.
Books, collages, and prints are made specifically from your submitted artwork and are personalised for you. As these products are made to your specifications or are clearly personalised, the standard 14-day cancellation right for distance purchases does not apply under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.
This does not affect your statutory rights. If your order arrives faulty, damaged, not as described, or incorrectly produced, please contact us and we will work to resolve the issue. This will usually involve a replacement (with reprinting and redelivery typically taking 1–3 weeks). Where a repair or replacement is not possible or does not resolve the issue, you may have further remedies available, including a price reduction or refund, under the Consumer Rights Act 2015.
8. Acceptable use
You agree not to:

Use the Site or Services for any unlawful purpose.

Attempt to interfere with, disrupt, or gain unauthorised access to the Site or our systems.

Submit artwork or details you do not have the right or authority to submit (see Section 2).

Impersonate another person or misrepresent your relationship to a child whose artwork you submit.
We may refuse or cancel an order at our discretion, including where we reasonably suspect misuse of the Services or a breach of these terms.
9. Liability
Nothing in these terms limits or excludes any rights you have as a consumer that cannot legally be limited or excluded, including your rights under the Consumer Rights Act 2015.
Subject to the above, our liability to you for any claim arising from these terms or your order is limited to the amount you paid for the relevant order. This limitation does not affect your statutory rights. We are not liable for indirect or consequential losses.
10. Indemnity
If you breach Section 2 (for example, by submitting artwork you don't have the right to submit, or misrepresenting your authority to share a child's details with us) and this results in a third-party claim against us, you agree to reimburse us for reasonable losses directly caused by that breach.
11. Privacy
Our Privacy Notice explains how we collect, use, store, and protect your personal information.
12. Governing law and jurisdiction
These terms are governed by the law of Scotland. Any dispute may be brought before the Scottish courts. If you are a consumer resident elsewhere in the UK, you may also be entitled to bring proceedings in the courts of your home jurisdiction.
13. General
If any part of these terms is found unenforceable, the rest remains in effect. Our failure to enforce a term is not a waiver of it. These terms, together with our Privacy Notice, form the entire agreement between us regarding the Services.
